Arbitrator

An arbitrator is one, who is appointed by the contending parties for negotiation and settlement of a dispute referred to him. Since, he is appointed by the parties to the dispute at their own choice, anybody, including a minor or one of themselves may be appointed as an arbitrator. But when the parties cannot appoint any arbitrator or if an appointed arbitrator neglects or refuses to act or is incapable of acting or dies, and if such vacancy is not duly filled within 15 days of the notice by any party on the other parties to fill such a vacancy, the court, on the application of the party who gave notice to other parties for filling the vacancy, may appoint an arbitrator or arbitrators. The court, on receiving an application from any of the parties can remove an arbitrator when he fails to proceed with the reference or when he has misconducted himself of the proceedings.
